Regulations have been Approved which Enable Employers to send Wages Slip Online

Regulations which were recently approved by the Knesset will enable employers to deliver wages slips to employees online.  Section 24 of the Wage Protection Law, 5718-1958 provides that employers must send employees written salary slips, and the Minister was empowered to determine, after consultation with employee and employer organizations and after the approval of the Labor Committee of the Knesset, 'special ways of delivering the wages slips, to categories of employers or employees'.  Notwithstanding that provision, until now no regulations were promulgated addressing the ways by means of which the wages slip will be sent, and whether this should be physical service or whether it can be online.

The novelty in the new Regulations is that from now on, the employer will be allowed to send the wages slip to the employee otherwise than in a written physical manner, using an email which meets basic information security requirements or to the email address at the employer or to the private email address of the employee or via a secure internet site of the employer, provided that the employee has consented to the same in writing by signing on a form which is appended to the Regulations.  It is important to mention that even if the employee has signed on such consent, he can withdraw from the same at any time and then the employer will be obliged to deliver him the wages slip physically.  There is no change to the periods within which the slip has to be delivered to the employee.

The Regulations further provide that in the event of delivery by email, the employee is required to confirm by return email that he received the slip.  If no such confirmation is received within 5 days, the employer is required to deliver the wages slip physically to the employee.  Likewise if use is made of an internet site to deliver the wages slip, the site must enable the employee access in the site to the slips of the last 12 months.  In any event, if the employee wishes, he must be able to receive printed copies of the slips from the employer going back over a period of seven years.
