בעקבות עניין פלאפון בג"ץ מאשר: התנגדות המעסיק להתארגנות מהווה הפעלת לחץ לא הוגן על העובדים
Further to the Pelephone matter the Supreme Court (sitting as the High Court of Justice) has approved: the Employer Objections to the Employee Organizations Constitute Unfair Pressure on Employees 

logo2בפני בית הדין האזורי לעבודה בתל אביב התנהלו הליכים בין הסתדרות העובדים הכללית החדשה לבין חברת פלאפון תקשורת בע"מ שעניינם התארגנות ראשונית של עובדי פלאפון במסגרת ההסתדרות. ההסתדרות פנתה לבית הדין האזורי לעבודה בבקשה לצווים שונים נגד פעולות שבהן נקטה פלאפון, הפוגעות לטענתם בחופש ההתארגנות של עובדיה.

בבית הדין האזורי נקבע כי אין פסול בכך שהמעסיק יפנה לעובדיו בדרכים שונות, מבלי להשפיע עליהם באופן מאיים או פסול ויביע עמדתו בנוגע לחברות בארגון עובדים. עוד צוין שאף בהתנהלות ההסתדרות נפל פגם משזו נעשתה בהיחבא ובלא תקשורת עם הנהלת החברה. על ההחלטות האמורות הוגש ערעור לבית הדין הארצי לעבודה על ידי ההסתדרות. במסגרת הדיון נתבקשו היועץ המשפטי לממשלה ולשכת התיאום של הארגונים הכלכליים להגיש עמדתם.

פסק דינו של בית הדין הארצי לעבודה ערך דיון מקיף בשאלה שניצבה לפתחו תוך התייחסות לזכויות היסוד הניצבות על כף המאזניים – חופש הביטוי של המעסיק וזכותו לקניין מזה וזכות ההתארגנות של העובד מזה. בית הדין קבע כי בתקופת ההתארגנות הראשונית, עד לכינונו של ארגון עובדים יציג טרם הבשלתו של שיח קיבוצי בין הצדדים, קמה החזקה לפיה הבעת עמדה על ידי המעסיק או מטעמו בנוגע להתארגנות או השלכותיה, לרבות 'הטבות' בעטיה של ההתארגנות או שלילתן, מהווה הפעלת לחץ, כפיה והשפעה בלתי הוגנים על העובדים במימוש זכותם להתארגן או שלא להתארגן. אשר על כן בנסיבות של התארגנות ראשונית עד לכינונו של ארגון יציג זכותו של המעסיק לביטוי אינה שוות משקל לזכות העובדים לחופש ההתארגנות בארגון עובדים וזכות העובדים להתארגנות בארגון עובדים גוברת על זכות המעסיק לחופש הביטוי.

לחזקה הפסיקתית שצוטטה שיצר בית הדין הארצי לעבודה, ולכללים שהתווה ביחס להתנהלות הצדדים במהלכי התארגנות ראשונית, הצטרפו כללים מנחים "כאמת מידה לבחינת מימוש זכות ההתארגנות או הפרתה". כך למשל המעסיק לא יקבע בחוזה עבודה הטבות ולא יתן הבטחות להטבות חריגות לעובדים בשל היותם מאורגנים או בלתי מאורגנים; המעסיק לא יביע עמדה ביריבות בין ארגונים באשר ליציגות במקום העבודה ובכל הנוגע להתארגנות, להשלכותיה ולמימוש הזכות להתארגנות; המעסיק לא יפנה לעובדים בתכתובת אישית באמצעים אלקטרוניים או אחרים ולא יקיים פגישות עם עובדים בקבוצות או בשיחות אישיות.

בעתירה שהגישה לשכת התיאום של הארגונים הכלכליים לאחרונה לבית המשפט הגבוה לצדק נטען נגד קביעת החזקה הפסיקתית על ידי בית הדין ונגד כמה מן הכללים שקבע בית הדין הארצי לעבודה. לשיטת ההסתדרות פסק הדין עולה בקנה אחד עם העקרונות ועם הכללים שנקבעו בפסיקת בית הדין זה מכבר ולפיהם מעסיק אינו רשאי להשפיע על עובדיו במימוש זכותם להתארגנות.

בית המשפט העליון החליט, בפסק דינו של כבוד השופט רובינשטיין, כי אין להיעתר לעתירה ולהתערב בהחלטת בית הדין הארצי לעבודה. הוא ציין כי שלב ההתארגנות הראשונית הוא שלב ראשוני ורגיש במיוחד. באותה עת העובדים עדיין אינם מאוגדים, הם אינם קבוצה שכוחה מוקנה לה מעצם חבירתם של פרטים רבים לכלל והם חשופים להפעלת כוחו של המעסיק. בשלב זה עדיין כל עובד לעצמו ויכולתו לעמוד על זכויותיו מוגבלת יחסית. הטעמים המובילים עובדים להתארגן הם אלה שמטבע הדברים מובילים את המעסיק שלא לראות בעין אוהדת התארגנויות עובדים וגם העותרת אינה מתכחשת לכך. במציאות האנושית נודעת למעסיק בכגון דא השפעה גלויה או סמויה, עדינה יותר או פחות. בנשימה אחת ברי כי לאחר כינון יחסי עבודה קיבוציים חשוף המעסיק לצעדים ארגוניים חוקיים ומארג הכוחות הקיים מתערער שלא לטובתו. נוכח התארגנות ראשונית וחלוקת הכוח מחדש אין בידי המעסיק לעשות את כל שהיה נתון בידיו קודם לכן. היקף שליטתו של המעסיק במקום העבודה, יחסי המרות בין המעסיק לעובד ותלותו של העובד במעסיק, משתנים. על סמך כל אלה מאמץ בית המשפט הגבוה לצדק את הלכת בית הדין הארצי לעבודה בדבר החזקה לפיה הבעת עמדה על ידי המעסיק בנוגע להתארגנות מהווה לחץ והשפעה בלתי הוגנים על העובדים במימוש זכותם להתארגן.

Proceedings were brought before the regional Labor Court in Tel-Aviv between the new General Workers' Union (Histadrut) and Pelephone Communications Ltd concerning the initial phase of the organization of Pelephone's employees within the framework of the Histadrut. The Histradrut approached the regional Labor Court applying for various orders against the actions taken by Pelephone, which – the Histadrut alleged – damaged the Pelphone employees' freedom of organization.

The regional Labor Court decided that there is no prohibition against the employer approaching its employees in different ways so as to present the employer's stand to the organization of employees, provided this does not give rise to a threat or to prohibited behavior.  
The Court did also mention that even the behavior of the Histadrut itself was not free from problems, in that it was done secretly without any communication with the management of the company.   The Histadrut filed an appeal against these decisions with the National Labor Court.

During the hearings, the legal advisor to the Government and the Federation of Economic Organizations were also requested to file their positions on this matter.

The decision of the National Labor Court contained a full discussion on the question placed before it, taking into account the basic rights which are in balance – the freedom of expression of the employer and its proprietary rights as against the freedom of organization of the employees. The Court decided that during the initial phase  of organization, until the employees' organization has appointed a representative and before a collective dialogue between the parties has matured, there is a presumption according to which the presentation of the position of by the employer or by someone on its behalf concerning the organization or its implications (including the 'benefits'  deriving from such organization or the negation of such benefits), constitutes the imposition of unfair pressure and influence on the employees when exercising their right to organize or not to organize.  

Accordingly, during the phase of initial organization until the appointment of a representative union, the employer's right of freedom of expression does not carry the same weight as the employees' right of organization via an employees' union, and the employees' right of organization via an employees' union takes precedence over the employer's freedom of expression.

To the presumption mentioned above, which was created by the National Labor Court, and the rules which were outlined concerning the behavior of the parties during the initial organization phase, there were added guidelines to 'measure the use of the right of organization and whether it was breached'. So for example, the employer cannot offer benefits in the employment contract  or offer provide exceptional guarantees for the benefits to employees on the basis of whether the employee is organized into a union or not; the employer cannot bring about rivalry between employee organizations by presenting its stand on organization, its effects and the right to organize; the employer should not approach employees in writing personally whether via email or otherwise, and should not set up meetings with groups of employees or hold individual conversations with them.
 
In the petition which was recently filed with the Supreme Court (sitting as a High Court of Justice) by the Federation of Economic Organizations, it raised objections to  the setting of the presumption by the National Labor Court, as well as to some of the guidelines which the National  Labor Court also spelt out.  According to the Histadrut, the decision of the National Labour Court stands hand in hand with principles and with the general rules which were set forth by the court some time ago, and according to which the employer is not entitled to influence its employees in the exercise of their right to organize.

The Supreme Court decided, in a judgment handed down by His Honor Mr. Justice Rubinstein, that there is no need to grant the petition and to interfere with the decision of the regional Labor Court.  He mentioned that the initial organization phase is especially sensitive. At that time the employees are not yet organized, they are not yet a group with the power of a union for all members, and the employees are exposed to the exercise of power by the employer.  At this stage, each employee still needs to stand on his or her own rights, which are relatively limited. The factors leading the employees to organize are those, which by their very nature will drive the employer not to look favorably upon the employees' organization, and this was not actually denied in the petition which was filed with the court.  The human reality is known to influence the employer – whether openly or not and whether in a subtle manner or not.  One thing is clear, after the establishment of the employees' organization, the employer is exposed to legal organizational steps and this can bring the existing power together in a manner not favorable towards the employer.   

On the basis of all of this, the Supreme Court sitting as a High Court of Justice, adopts the precedence of the National Labor Court regarding the presumption according to which the presentation of a stand by the employer with regard to the organization constitutes unfair pressure and influence on the employees when exercising their right to organize.
