Expansion Trend in Case Law - Encouraging Preference for Israeli Produce in Tender
Dear clients,

Under the Mandatory Tenders Regulations (Preference For Israel Products And Mandatory Business Cooperation), 1995 ("the Preference Regulations"), tender documents published by the State and Government Corporations must include a relative preference for bids which include purchasing Israeli goods rather than imported goods.
 
The preference applies only to tenders for the supply of goods, not to service provision tenders. This creates an inherent tension in tenders that combine the interrelated supply of goods and provision of services.
 
Over the past few months we have witnessed an expansion trend in case law, applying preference for Israeli products in tenders combining supply of goods and provision of services. The following update will review the rate and conditions for the preference, as well as recent rulings in the field.
