Israel's District Court Sets the Standards for Follow Up Litigation Against Members of Alleged Foreign Cartels
Dear Clients and Friends,

Private enforcement of the Competition Law in Israel has been vibrant in recent years. One of the most noticeable trends in this respect is the emergence of follow up class actions, which typically involve a local plaintiff seeking compensation for alleged harm incurred in Israel as a result of an international cartel.

These proceedings rest, almost solely, on a decision or settlement between foreign authorities and alleged cartel members. Earlier this week, the Israel District Court rendered an important decision that raises significant hurdles on the path of local plaintiffs seeking to initiate such follow up proceedings.

The decision will require future plaintiffs to demonstrate a more concrete relation between the alleged international cartel and the Israeli market. You can find a short summary of the decision and its key implications in this client alert that was prepared by our Competition Law Practice Group.

We invite you to contact us with regards to the proposed reform, or in any other matter.
