We Won! After a decade-long struggle, the Knesset approval last month of the Basic Law: Nation State is a huge step towards the creation of a constitutional balance between the Jewish and democratic elements of the State of Israel. To celebrate the occasion, we return to the studies published by the Institute which constituted an important part of the Knesset discussions, together with a collection of other references to the issue.

Illegal building, water theft, road fatalities… The areas of Judea and Samaria under Civil Administration control ("Area C") are suffering from an absence of law enforcement in many fields. This issue is the subject of this month's study which also examines the problem's origins and possible ways for rectifying the situation.

Claims that criminal and civil law is not properly enforced in Judea and Samaria are not a recent phenomenon. They have been aired for many years both by the local residents and government authority figures and were reinforced in various State Comptroller reports issued over recent years. Phenomena of water theft, violations of planning and construction laws and traffic violations are common in this area and harm the orderly daily lives of the citizens living there, Jews and Arabs alike. This area's special political and legal status especially serves to magnify these problems.
The study conducted by Netanel Simcha Nachshon focuses on three test cases: enforcement of building laws, enforcement of water laws and enforcement of traffic laws. Several of the main findings are presented below: 
The findings in the field of building indicate significant under-enforcement. This means that many illegal buildings are not demolished, a state of affairs that stems from coordination and policy failures at different stages of the demolition process. Furthermore, there is no criminal enforcement enacted against those violating the building laws.

In the area of water-related offenses, the study revealed that the lack of coordination between all the entities involved leads to a reality in which water is stolen in Judea and Samaria almost unhindered. The authorities fail to efficiently seal off the illegal drillings and to disconnect the illegal water connections. Here too, there is no criminal enforcement against violators of the law.
There are two legal systems for traffic offenses in Judea and Samaria: the Palestinians are judged before military courts and the Israelis are tried by an Israeli court. A dispute over authority between the military prosecution and the Judea and Samaria Police Force has led to Palestinian drivers who are suspected of traffic offenses almost never being brought to trial in military courts.

Nation State law

The Basic Law: Israel as the Nation-State of the Jewish People has been successfully approved however in light of the public storm surrounding it, it is worthwhile taking another look at its origins. Over the past decade, the Institute has published several studies on the theoretical justifications and foundations of the Nation State Law. We are publishing them again as a service to the public
